Regional Elections Update

The NLRB has resumed elections and given complete discretion on election details to the Regional Directors. The purpose of this page is to give clients and law firms an “in one place” way to see how different regions are directing new elections. NOTE: These are not official statements from regional directors, but experiences shared by attorneys and clients communicating with staff about pending petitions in the regions listed below. This is a fluid situation and regions may (and probably will) change their stance, so check back here often for updates as we receive them. If you have experience with an election in any region please let us know and we’ll add it to the page.

Region 1: Boston

  • Updated (August 31, 2020) Regional Director issues decision August 31, 2020 directing mail ballot election over objection of the employer (union preferred a mail ballot due to COVID-19); ballots mailed on September 16, 2020 and must be received by October 5, 2020; ballots will be counted virtually on a date TBD.
  • Updated (August 24, 2020) Regional Director issues decision August 24, 2020 directing mail ballot election due to COVID-19 over objection of the employer and union; ballots mailed on September 11, 2020 and must be received by October 2, 2020; ballots will be counted virtually on October 7, 2020.
  • Updated (June 15, 2020) Regional Director issues decision June 15, 2020 directing mail ballot election over objection of employer (union preferred mail ballot due to COVID-19); ballots mailed on June 22, 2020 and must be received by July 10, 2020; ballots will be counted virtually on July 14, 2020.
  • Updated (May 29, 2020): RD Directs mail ballot election in decision issued on May 29, 2020 over objection of employer who offered safe ways to conduct manual ballot election; ballots mailed on June 23, 2020 and must be received by July 21, 2020. Ballots will be counted on date to be determined.
  • Updated (May 28, 2020): RD Directs mail ballot election in decision issued on May 28, 2020. All employees laid off. Employer objected to election while on layoff, but both employer and union argued for mail ballot. RD finds mail ballot election appropriate, ballots mailed on June 16, 2020 and must be received by July 14, 2020. Ballots will be counted on July 14, 2020.
  • Updated (May 7, 2020): RD Directs mail ballot election in decision issued on May 7, 2020 over objection of employer who offered safe ways to conduct manual ballot election; ballots mailed on May 26, 2020 and must be received by June 22, 2020. Ballots will be counted virtually on June 26, 2020.

Region 2: New York

  • Updated (August 4, 2020) Regional Director issues decision August 4, 2020 directing mail ballot election over objection of the both the employer and union; ballots mailed on August 14, 2020 and must be received by September 4, 2020; ballots will be counted virtually on a date TBD from September 11 through September 18, 2020.
  • Updated (June 9, 2020) Regional Director issues decision June 9, 2020 directing mail ballot election over objection of both employer and union; ballots mailed on June 19, 2020 and must be received by July 10, 2020; ballots will be counted virtually on a date TBD between July 24, 2020 and July 31, 2020.
  • Updated (April 29, 2020): RD Directs mail ballot election in decision issued on April 17, 2020 over objection of employer who offered safe ways to conduct manual ballot election; ballots mailed on April 30, 2020 and must be received by May 22, 2020. Ballots will be counted virtually on June 4, 2020.
  • Attorney reports that Regional Director is attempting to push toward mail ballots.
  • Agreed to include language in stips by which union waives any objections based on lack of physical posting and acknowledging email is sufficient

  • Updated (June 26, 2020) Regional Director issues decision June 26, 2020 directing mail ballot election over objection of the employer (mail ballot directed due to COVID-19); ballots mailed on July 10, 2020 and must be received by August 7, 2020; ballots will be counted (either in person or otherwise) on August 14, 2020.

  • Board agent stated that the Region’s position will be that it will schedule elections beginning June 15

  • Updated (July 17, 2020) Regional Director issues decision July 17, 2020 directing mail ballot election due to COVID-19 over objection of the employer (union supported a manual election if it did not delay the conduct of the election) ballots mailed on July 29, 2020 and must be received by August 21, 2020; ballots will be counted virtually on August 28, 2020.
  • Updated (July 6, 2020) Regional Director issues decision July 6, 2020 directing mail ballot election over objection of the employer (union did not take a position on whether the election should be conducted by manual or mail ballot); ballots mailed on July 15, 2020 and must be received by August 5, 2020; ballots will be counted (virtually) on August 12, 2020.
  • Updated: (May 4, 2020): Regional Director directs mail ballot election in decision issued on May 4, 2020 over objection of employer who offered safe ways to conduct manual ballot election; ballots mailed on May 19, 2020 and must be received by June 19, 2020. Ballots will be counted on June 26, 2020 and parties may attend virtually.
  • Holds RC election in abeyance indefinitely while hospital deals with COVID-19 due to the fact that it is a healthcare facility and the employer rejected a mail ballot.

Region 8: Cleveland

  • Updated: (May 26, 2020): Regional Director directs mail ballot election in decision issued on May 26, 2020 over objection of employer who offered safe ways to conduct manual ballot election; ballots mailed on June 1, 2020 and must be received by June 22, 2020. Ballots will be virtually counted on June 22, 2020.

Region 9: Cincinnati

  • Updated (June 18, 2020) Regional Director issues decision June 18, 2020 directing mail ballot election as requested by both the Employer and Petitioner due to COVID-19; ballots mailed on June 25, 2020 and must be returned by July 17, 2020; ballots will be counted virtually on July 20, 2020.
  • Updated: (May 29, 2020): Regional Director directs mail ballot election in decision issued on May 29, 2020 over objection of employer; ballots mailed on June 5, 2020 and must be received by July 7, 2020. Ballots will be counted on July 8, 2020 and parties may attend virtually.
  • Updated: (May 12, 2020): Regional Director directs mail ballot election in decision issued on May 12, 2020 over objection of employer; ballots mailed on May 22, 2020 and must be received by June 19, 2020. Ballots will be counted on June 22, 2020 and parties may attend virtually.

Region 10: Atlanta

  • Updated (October 8, 2020) Regional Director issued decision October 8, 2020, directing mail ballot election over objection of the employer ( the union preferred mail ballot election due to COVID-19); ballots mailed on October 23, 2020 and must be returned by November 19, 2020; ballots will be counted virtually on November 20, 2020.

  • Updated (August 18, 2020) Regional Director issues decision August 18, 2020 directing mail ballot election over objection of the employer (union preferred a mail ballot due to COVID-19); ballots mailed on September 9, 2020 and must be received by September 30, 2020; ballots will be counted virtually on October 1, 2020.
  • Updated (August 4, 2020) Regional Director issues decision August 4, 2020 directing mail ballot election over objection of the employer (union preferred a mail ballot due to COVID-19); ballots mailed on August 18, 2020 and must be received by September 15, 2020; ballots will be counted virtually on September 16, 2020

Region 12: Tampa

  • Updated (October 1, 2020) Regional Director issued decision October 1, 2020, directing mail ballot election over objection of the employer and the union; ballots mailed on October 13, 2020 and will be commingled and counted virtually on November 10, 2020. To be valid ballots must be received prior to the count.
  • Updated (September 10, 2020) Regional Director issued decision September 10, 2020, directing mail ballot election due to COVID-19 over objection of the employer and union; ballots mailed on September 25, 2020 and must be received prior to the ballot count; ballots will be counted virtually on October 16, 2020.
  • Updated (September 9, 2020) Regional Director issued decision September 9, 2020, directing mail ballot election due to COVID-19 over objection of the employer (union’s preference was not documented); ballots will be mailed on September 22, 2020 and must be received prior to the ballot count; ballots will be counted on October 13, 2020.
  • Updated (July 16, 2020) Regional Director issues decision July 16, 2020 directing mail ballot election over objection of the employer (union preferred mail ballot due to COVID-19); ballots mailed on July 29, 2020 and must be received by September 2, 2020; ballots will be counted, location TBD, in person or otherwise on September 9, 2020.
  • Updated (May 29, 2020): Regional Director directs mail ballot election over objection of both employer and union. Decision issued on May 29, 2020; ballots mailed on June 9, 2020 and must be received by June 30, 2020. Ballots will be counted virtually on June 30, 2020.
  • Updated (May 26, 2020): Regional Director overrules employer objections over revoking stipulated election agreement and directs mail ballot election. RD revoked stipulated election agreement and directs mail ballot over objection from employer and union prefers mail ballot. Decision issued on May 26, 2020; ballots mailed on June 4, 2020 and must be received by June 25, 2020. Ballots will be counted virtually on June 25, 2020.
  • Updated (May 18, 2020): Regional Director directs mail ballot election. RD revoked stipulated election agreement and directs mail ballot over objection from employer and union prefers mail ballot. Decision issued on May 18, 2020; ballots mailed on May 28, 2020 and must be received by June 18, 2020. Ballots will be counted virtually on June 18, 2020.
  • Updated (May 13, 2020): RD directs mail ballot election. Employer objects to mail ballot and union prefers mail ballot. Decision issued on May 13, 2020; ballots mailed on May 28, 2020 and must be received by June 23, 2020. Ballots will be counted virtually on June 23, 2020.
  • Updated (May 8, 2020): RD directs mail ballot election. Employer objects to mail ballot and union prefers mail ballot. Decision issued on May 8, 2020; ballots mailed on May 26, 2020 and must be received by June 17, 2020. Ballots will be counted virtually on June 17, 2020.
  • Updated (April 23, 2020): The Regional Director in the case described below revoked the stipulated election agreement of the parties and ordered a hearing on May 1, 2020 for the primary purpose of determining whether a manual ballot or mail ballot should be used in this election.
  • Board agent stated that the Region has not yet decided how it intends to proceed with elections. He did disclose that, as of now, most Regional Directors have concluded that they do not have authority to order a mall ballot election, unless the parties agree to that election procedure.
  • There are two remaining possibilities moving forward: (1) the Regional Director could continue to stay all manual elections until circumstances improve, or (2) the Regional Director could revoke their approval of the parties’ stipulated election agreement and hold a telephonic hearing on the sole issue of holding a mail ballot versus a manual election. The agent would not provide an assessment of which avenue is more likely, but he did make clear that the second option is a distinct possibility.
  • Board agent does not anticipate that the Board will be in a position to hold manual elections anytime soon.

Region 13: Chicago

  • Updated (August 14, 2020) Regional Director issues decision August 14, 2020 directing mail ballot election; ballots mailed on August 21, 2020 and must be received by September 15, 2020; ballots will be counted on September 17, 2020.
  • Updated (August 12, 2020) Regional Director issues decision August 12, 2020 directing mail ballot election; ballots mailed on August 19, 2020 and must be received by September 14, 2020; ballots will be counted virtually on September 16, 2020.
  • Updated (June 24, 2020) Regional Director issues decision June 24, 2020 directing mail ballot election; ballots mailed on July 15, 2020 and must be returned by August 10, 2020; ballots will be counted on August 12, 2020.
  • Updated (June 10, 2020) Regional Director issues decision June 10, 2020 directing mail ballot election; ballots mailed on June 16, 2020 and must be received by July 6, 2020; ballots will be counted on July 13, 2020.
  • Updated (May 18, 2020): Regional Director issues decision on May 18, 2020, finding that Security Specialists for a charter school are guards under the Act and therefore not eligible for inclusion in a non-guard voting unit. The RD then directs mail ballot election. This decision once again does not explain his reasoning but instead notes, “Since pursuant to the Board’s Rules and Regulations, Section 102.66(g)(1), the type of election is not a litigable issue, my rationale for directing a mail ballot election is set forth in a separate letter.” The position of the parties on the mail ballot question was not stated in the decision. Ballots will be mailed on May 29, 2020 and must be received by June 24, 2020; ballots will be counted on July 1, 2020 but decision does not state whether that will happen in-person or virtually.
  • Updated (May 12, 2020): Regional Director issues decision on May 12, 2020 directing mail ballot election. Interestingly the decision once again does not explain his reasoning but instead notes, “Since pursuant to the Board’s Rules and Regulations, Section 102.66(g)(1), the type of election is not a litigable issue, my rationale for directing a mail ballot election is set forth in a separate letter.” The position of the parties on the mail ballot question was not stated in the decision. Region 14: Kansas City

  • Updated (September 24, 2020) Regional Director issued decision September 24, 2020, directing mail ballot election over objection of the employer (union preferred a mail ballot due to COVID-19); ballots mailed on October 16, 2020 and will be commingled and counted virtually on November 13, 2020. To be valid ballots must be received prior to the count.
  • Updated (September 3, 2020) Regional Director issues decision September 3, 2020 directing mail ballot election over objection of the employer (union preferred a mail ballot due to COVID-19); ballots mailed on September 18, 2020 and must be received by October 16, 2020; ballots will be counted on October 23, 2020.
  • Updated (August 19, 2020) Regional Director issues decision August 19, 2020 directing mail ballot election over objection of the employer (union preferred a mail ballot due to COVID-19); ballots mailed on September 11, 2020 and must be received by October 2, 2020; ballots will be counted virtually on October 2, 2020.
  • Updated (June 17, 2020) Regional Director issues decision June 17, 2020 directing mail ballot election over objection of employer (union preferred mail ballot due to COVID-19); ballots mailed on June 29, 2020 and must be returned by July 27, 2020; ballots will be counted (either in person or otherwise) on August 3, 2020.
