Developments at the NLRB and in Congress may have the desired impact employers are hoping for. This is the gist of what Phil Wilson confirmed for SHRM reporter Allen Smith yesterday. Two issues are coalescing to roll back the ambush election rule – a Republican majority on the National Labor Relations Board and an appropriations bill (H.R. 3354) that prevented funding of the NLRB to enforce the ambush elections rule. Although it is debatable whether the amendment will pass scrutiny, according to Wilson, it “could have the intended effect and justify a new rulemaking to reverse the rule.”
