After an invitation to interested parties to file briefs on whether or not the board should assert jurisdiction over charter schools “as a class” back in February, the NLRB ruled on March 25th that a New York charter school fell under Board jurisdiction. This means that the Board will continue to assert jurisdiction over charter schools on a case-by-case basis – an unfortunate decision for unions as it holds charter school to federal labor laws, which require a secret ballot election as opposed to the “card check” that many state public education laws allow.
