Breaking: Member Pearce Letter to Hayes Reports Hayes is Considering Resigning

In response to a letter from Board Member Brian Hayes to Congressman John Kline (which we published last week) Board Chairman Pearce published a scathing reply today. In Pearce’s reply he responded to the issues Hayes brought up in his letter. In addition he illuminated much of the “behind the scenes” negotiations/strong-arming going on between the majority members and Member Hayes. It is a fascinating read, but the most important news is that clearly member Hayes is considering resigning (in fact according to Pearce he has threatened to do it on multiple occasions prior to last week) in order to stop the NLRB “ambush election” rulemaking from going into effect. If true it looks like we may be down to a 2-member Board as early as next week. We will keep you posted on developments.
