McKnight’s Long Term Care News & Assisted Living contacted LRI president Phil Wilson to get his perspective on the challenges facing the industry. An August webinar led by Wilson, Rising Storm in LTC, highlighted dozens of issues converging in the LTC arena, making it a highly-charged environment susceptible to continued union organizing pressure.
“If you look at next year,” Wilson says, “you’re going to see brutal political campaigns, possibly a second recession but certainly not any dramatic [economic] growth, long-term care will stay under the same pressures it’s been under, and more and more people are going to be in nursing homes.”

The May 21, 2010 issue of The Journal Record (Oklahoma business journal) featured an interview with Phil Wilson, President of LRI, about the vulnerability of QSR businesses (quick service, or “fast food,” restaurants) to union organizing drives. Wilson believes these businesses could be a looming target for unions, especially the member-bleeding SEIU. “QSR companies are sitting ducks, and they better prepare immediately for a rapidly changing labor environment,” Phil stated. Phil referenced a leaked December 2009 document suggesting the SEIU planned to penetrate the fast-food sector, generally the arena of the United Food & Commercial Workers. The motivation arises from the fact that QSR businesses cannot move their jobs overseas to evade union encroachment.

Most legal scholars and labor experts believe that the NLRB has the authority to enact procedural changes that could, among other things:
• drastically shorten the time frame for holding union elections;
• eliminate cumbersome pre-election procedures that allow employers to dispute who is eligible to vote in such elections;
• require the employer to turn over employee names, addresses and phone numbers early in any union organizing drive;
• require equal access to both workers and the workplace for unions during campaigns; and
• increase the penalties on companies that violate their workers’ legal rights.
The NLRB even could make it easier for workers to unionize based on a card check showing of majority support–just as the EFCA would. It could force employers to recognize a union as the representative of its employees so long as a neutral third party verified that more than 50

Although the Senate appears to have been happy to focus on health care “reform” and thus avoid the discussion of the Employee Free Choice Act, it seems the Senate has painted themselves into a corner by pushing a version of the health care bill that includes a tax on “Cadillac” health plans, while excluding a full public option. Both the House and Big Labor are opposed to the “Cadillac tax,” and the unions were hoping for a full-monty public option.
