Cost of Unfair Labor Practice Charges

This session was presented by four attorney members of CUE’s Labor Lawyer’s Advisory Committee. As a labor lawyer already well-versed in the legal issues presented, I was not the intended audience. But based on the questions asked from the audience (imagine, four top labor lawyers answering your questions for free!) I think most people found the session quite helpful. The basic take-away was to treat ULP charges as you would any litigation decision (the excellent point here was that when unions get involved many companies make emotional decisions they would not necessarily make if it was a single plaintiff discharge or discrimination claim) and to carefully consider all the potential costs, including back pay, interest and (of course) legal fees.
